Individuals who enter the USA without permission after accruing one year or more of unlawful presence in the USA, OR who enter unlawfully after deportation, are subject to the so-called “permanent bar.”

The permanent bar prevents an immigrant from legalizing their status through a family member until they spend at least 10 years outside the United States. It is one of the most unjust and unforgiving provisions of U.S. immigration law.

In this video immigration attorneys, Jennifer Walker Gates and Diego Nuñez help us understand a little bit about this law and its processes.
